how to make "I agree with Terms and Conditions" checkbox default to selected?

You can just add checked="true" to the tag but I wouldn't. If the customer doesn't do anything to affirmatively agree it won't count legally as agreement.

Thanks Marcus! The other way I have seen this done .....and I am not sure of the legal ramifications...is to not use the agree to terms checkbox, but simply state "by clicking place order" you agree to the sites Terms & Conditions.

Derek,

We have been burned on this. Even the "you agree" is not enough. The credit card companies told us that your terms and conditions MUST be displayed on your checkout page, not just a checkbox. Otherwise your are liable for any and all chargebacks.

There is nothing like that is default to do these rules to agree.But I think there is software to do this....

Agreed, it is not enough to have the customer agree, the terms must appear on the page. A simple text box or something.
